Terms of Service

These terms govern your use of this website (hoogway.ai, including the live demo on the homepage), Hoogway Leads (leads.hoogway.ai) and Hoogway Hiring (app.hoogway.ai), together “the services”, operated by Hoogway AI (“Hoogway”, “we”). By using the services you agree to them. If your organisation has a signed agreement with us, that agreement prevails where the two differ.

1. What the services are

Hoogway Leads lets businesses build and run AI voice agents that make and take phone calls, and reports what happened on each call. Hoogway Hiring lets businesses screen and interview candidates with AI assistance. The website demo is a limited taste of the platform for evaluation.

2. The demo

The homepage demo is offered free, for evaluation, to people 18 or older. Demo conversations are with an AI agent and are recorded, transcribed and analysed so we can show you the call report — our Privacy Policy says how that data is handled. Only request a phone call to a number that is yours. We apply usage limits, and we may change or withdraw the demo at any time. Agents drafted in the demo are ephemeral until claimed and carry no service commitment.

3. Accounts

Keep your credentials safe; what happens under your account is your responsibility. Account holders must be 18 or older and authorised to act for the business they register.

4. Acceptable use — calling is regulated

You run the campaigns; you are responsible for them being lawful where you and the people you call are. In particular, you must:

• have a lawful basis to call every number you upload, and honour do-not-call registries, consent and telemarketing rules that apply to your calls;
• make the disclosures your jurisdiction requires — including that a call is recorded, and that the caller is an AI agent where the law requires saying so;
• not use the services for harassment, fraud, deception, impersonation of a real person or organisation, emergencies, or any unlawful purpose;
• not probe, overload or interfere with the services, or resell them without our written agreement;
• in hiring, use our reports as an aid, comply with the employment and anti-discrimination laws that apply to you, and make the hiring decisions yourself.

We may suspend or terminate access for abuse, and where the law requires it we will cooperate with lawful requests from authorities.

5. Your data and content

Your contact lists, call recordings, candidate files and configurations remain yours. You give us the licence needed to operate the services on them — to place the calls, store the recordings, run the analysis you configure — and nothing more. We do not train AI models on your content. Deleting data works as described in the Privacy Policy.

6. AI output

Transcripts, summaries, scores and screening reports are generated by AI and can be wrong. Review them before acting on them; do not treat them as legal, medical or professional advice, and do not make decisions about people solely on an automated output where the law restricts that.

7. Fees

Paid features are billed per your plan or order form. Charges for telephony and usage are as agreed there; taxes are extra where applicable. Fees are non-refundable except where the plan or the law says otherwise.

8. Third-party services

Calls travel over third-party carriers, and integrations you connect (calendars, CRMs, applicant tracking systems) are governed by those services' own terms. We are not responsible for a third party's availability or acts.

9. Our property

The services, their software, design and branding are Hoogway's or its licensors'. These terms give you a right to use the services, not any ownership of them.

10. Disclaimers and liability

The services are provided as-is; phone networks, AI models and third-party services are not fault-free and we do not warrant uninterrupted or error-free operation. To the extent the law allows, Hoogway is not liable for indirect or consequential loss, and our total liability for any claim is limited to the fees you paid us in the 12 months before the event — or, for free use including the demo, to ₹10,000. Nothing here limits liability that cannot lawfully be limited.

11. Indemnity

You will indemnify Hoogway against claims arising from your campaigns, your data, or your breach of section 4 — including claims from people you called without a lawful basis.

12. Termination

You can stop using the services and close your account at any time. We can suspend or terminate for breach of these terms, with notice where practicable. On closure, your data is handled as the Privacy Policy describes.

13. Governing law

These terms are governed by the laws of India and the courts of India have jurisdiction — without limiting any mandatory consumer rights you hold where you live.

14. Changes

If these terms change materially we will update the date at the top and tell account holders by email. Continuing to use the services after a change means you accept it.
